1. Service Description

WhatsAgent provides a personal AI assistant accessible via WhatsApp. Your agent can help with research, tasks, reminders, and more depending on your subscription plan.

2. Important Limitations

Memory & Data

Memory may reset: Due to technical issues, system updates, or maintenance, your agent's memory and context may occasionally be lost or reset.
No guarantee of persistence: We cannot guarantee that conversation history or learned preferences will persist indefinitely.
Backup important information: Do not rely solely on your agent to remember critical information. Keep important data backed up elsewhere.

AI Limitations

Your agent may make mistakes, misunderstand requests, or provide incorrect information
AI responses should not be relied upon for medical, legal, financial, or other critical decisions
Always verify important information independently
The agent's knowledge has a training cutoff date and may not reflect recent events

Service Availability

100% uptime is not guaranteed
WhatsApp or third-party service outages may affect availability
Scheduled maintenance may cause temporary interruptions

3. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE PRESERVED.

4. Limitation of Liability

IN NO EVENT SHALL HANDSOME / AIOW.IO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

Loss of data, memory, or conversation history
Decisions made based on AI responses
Business interruption or lost profits
Any damages exceeding the amount paid for the service in the past 3 months

5. Your Responsibilities

Backup important information elsewhere
Verify critical information independently
Do not share passwords, financial credentials, or highly sensitive personal data
Report issues promptly
Use the service in compliance with applicable laws

6. Data & Privacy

Conversations are stored to provide service continuity
Your data is isolated from other customers
We may access data for support, debugging, and service improvement
Data deletion available within 30 days of account cancellation

7. Payments & Refunds

Subscription billed monthly via Stripe
Cancel anytime; access continues until end of billing period
No refunds for partial months or unused credits
Top-up credits do not expire but are non-refundable

8. Termination

We reserve the right to suspend or terminate accounts that:

Violate these terms
Use the service for illegal purposes
Attempt to abuse or circumvent system limitations
Fail to pay subscription fees

9. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
